Welcome to MoonHoops. By accessing this website, placing an order, or using our products, you agree to be bound by these Terms of Service, our Return & Refund Policy, our Shipping Policy, and our Legal Notice (together, the "Terms"). If you do not agree, do not use this site or purchase from us.

1. General Conditions

You must be at least 18 years of age and have legal capacity to enter into binding contracts to purchase from MoonHoops. Products intended for use by minors must be purchased by an adult, and use by minors must be supervised by an adult. We reserve the right to refuse service to anyone, for any reason, at any time. Any breach of these Terms may result in immediate cancellation of your order.

2. Accuracy of Information

The content on this site is provided for general informational purposes only. While we make reasonable efforts to ensure accuracy, we do not warrant that product descriptions, pricing, or any other content is complete, current, or error-free. Use of this information is at your own risk.

3. Pricing & Service Modifications

All prices are subject to change without notice. We reserve the right to modify, suspend, or discontinue any product or service at any time without liability to you or any third party. Promotions and discounts are time-limited and subject to availability.

4. Product Display and Glow Feature

We make every effort to display our products as accurately as possible. However, we cannot guarantee that your screen's color calibration accurately reflects the exact colors of the physical product. Minor visual differences do not constitute grounds for a return or dispute.

The glow effect is produced by a light-activated (photoluminescent) material that must be charged by exposure to a light source. Brightness, color intensity, and glow duration vary depending on light exposure, ambient conditions, product size, and product age, and naturally diminish over time. Images, renders, and videos on this site (including "day" and "night" comparisons) are illustrative only and do not guarantee any specific level, color, or duration of glow.

5. Size Selection

Sizes 5, 6, and 7 and their recommended age ranges are indicated on the product page and are a general guide only. Choosing the correct size is the sole responsibility of the buyer. Orders are not eligible for return, refund, or exchange because of incorrect size selection.

6. Order Limitations & Cancellations

We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear fraudulent, abusive, or placed in unusually high quantities. Purchase limits may be applied per person, per household, or per order. In the event of a cancellation, we will attempt to notify you using the email address provided at checkout. By completing checkout, you confirm that the shipping address, email, and contact details you provided are accurate and complete.

7. Errors & Omissions

Typographical errors, pricing mistakes, or inaccuracies may occasionally appear on this site. We reserve the right to correct any errors and cancel any affected orders, even after an order confirmation has been sent, without liability. You will be notified and refunded in full if your order is cancelled for this reason.

8. Shipping, Delivery, Duties and Taxes

Shipping and delivery terms are governed by our Shipping Policy. Delivery estimates are not guaranteed. Customers are solely responsible for any import duties, customs fees, and taxes applicable in their country, and for providing a correct and deliverable address.

9. Damage Claims and Returns

Claims for transit damage or manufacturing defects must be submitted within 48 hours of delivery and must include a continuous, unedited unboxing video and proof of purchase, as set out in our Return & Refund Policy. Claims that do not meet these requirements will not be accepted. Returns are subject to the conditions of our Return & Refund Policy, which are incorporated into these Terms. We do not accept returns for incorrect size selection or for change of mind or dislike of the product.

10. Safe Use, Assumption of Risk and Buyer Responsibility

Basketball is a physical activity with inherent risks, including falls, collisions, sprains, fractures, and other injuries, which may be increased when playing outdoors, on uneven surfaces, or in low-light or nighttime conditions.

The buyer is solely and entirely responsible for the use of the product. By purchasing, you (i) assume 100% of the risks associated with the use of the product by you or any other person, including minors, (ii) agree that you are responsible for ensuring adequate supervision, lighting, playing surface, equipment, and physical fitness, and (iii) acknowledge that the glow feature does not replace adequate lighting or safety measures.

The product is not a toy for children under 3 years of age. Do not bite, chew, or ingest any part of the product. Inflate only to the pressure recommended on the product. Keep away from open flames, extreme heat, and sharp objects.

11. Intellectual Property

All content on this site, including but not limited to the MoonHoops name, logo, product images, and copy, is the exclusive property of MoonHoops, unless otherwise indicated. Unauthorized reproduction, distribution, or commercial use of any content is strictly prohibited. Any third-party names, marks, or logos that may appear on products or in images remain the property of their respective owners, and no affiliation, sponsorship, or endorsement is implied.

12. Prohibited Conduct

You agree not to use this site for any unlawful purpose, attempt to gain unauthorized access to the site or its systems, submit false or fraudulent information, or use fraudulent chargebacks or false claims to obtain refunds. We may cancel orders, restrict access, and pursue available legal remedies in such cases.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the site and products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except those that cannot be excluded under applicable mandatory law.

14. Limitation of Liability

To the maximum extent permitted by law, MoonHoops shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including personal injury, property damage, loss of profits, or loss of data, arising from the use of our products or this website. Our total liability in any case shall not exceed the purchase price paid for the specific product giving rise to the claim, excluding shipping, taxes, and duties.

15. Indemnification

You agree to indemnify and hold harmless MoonHoops, its owner, and its collaborators from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the product, the use of the product by any person under your care, or your breach of these Terms.

16. Payment Disputes and Chargebacks

Before initiating a dispute or chargeback with your bank, card issuer, or payment provider, you agree to first contact us at smithkeevin0@gmail.com and allow us a reasonable opportunity to resolve the issue. You acknowledge that these Terms, your order confirmation, shipping and delivery records, and our communications may be submitted as evidence in any dispute.

17. Governing Law and Exclusive Jurisdiction

These Terms are governed by the laws of the United Mexican States. The parties shall first attempt to resolve any dispute through good-faith negotiation for a period of 30 days after written notice. If unresolved, any dispute, claim, or controversy arising from or related to these Terms, this site, or any purchase shall be submitted exclusively to the competent courts of Mexicali, Baja California, México, and you expressly waive any other jurisdiction or venue that may correspond to you by reason of your present or future domicile or for any other reason.

18. Mandatory Consumer Rights

Nothing in these Terms excludes or limits any right that cannot be excluded or limited under the mandatory consumer protection laws of your country of residence. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

19. Changes to These Terms

We may update these Terms at any time. The version in effect at the time of your order applies to that order. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.

20. Entire Agreement and Severability

These Terms, together with our Return & Refund Policy, Shipping Policy, and Legal Notice, constitute the entire agreement between you and MoonHoops. Our failure to enforce any provision does not constitute a waiver of that provision.
